Terms & Conditions
All bookings are made with Kiff & Culture Pty Ltd (ABN 326 4736 4529). By booking a tour with us, you agree to have read and accept these Terms and Conditions.
The offer detailed in this proposal is valid up to within 14 days of the stated departure date, subject to availability. All prices are in Australian Dollars and include GST. Rates and conditions are subject to change without notice.
In order to secure a booking, we require a 50% deposit to be made. The 50% balance is due 30 days before departure. If your booking is made within 30 days of the departure date, then the full amount is payable at the time of booking.
If we accept your booking, we will issue an invoice. A contract will exist between us from the date we issue the invoice, or if you book within 30 days of departure, the contract will exist when we accept your payment. Please refer to your invoice for details regarding final payments. If this balance is not paid on or before the due date, we reserve the right to treat your booking as cancelled.
Kiff & Culture (ABN 326 4736 4529 ) (we, us) strives to provide its customers (you) with an enjoyable and safe trip. Occasionally unforeseen circumstances (including adverse weather conditions, mechanical faults, or an insufficient number of passengers for us to run the trip) require us to alter routes, itineraries, vehicle types, fares, days of operation or even cancel tours. We retain the right to do any of these things without notice (however, where practical we will endeavour to provide you with notice of alterations or cancellations). If our usual venues are booked out, we will endeavour to provide you with alternative venues which can provide a similar offering. Sometimes venues will be booked out due to weddings or other functions even after confirming our booking, whereby we will notify you but provide you with an alternative venue.
If we cancel your tour (except for when a Force Majeure Event occurs), you can transfer amounts paid to another departure date or receive a 100% refund. If the tour is cancelled because minimum numbers have not been met, we will refund your tour price in full.
If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services.
Cancellation due to Force Majeure
If a tour is cancelled due to a Force Majeure Event, we can offer you a choice of:
(a) a 110% credit of monies paid for your trip; or
(b) a refund minus unrecoverable costs.
If the cancellation due to a Force Majeure Event occurs after a trip has commenced, we can offer you a choice of a pro-rata:
(a) 110% credit for the days that remain on your trip; or
(b) refund minus unrecoverable costs of the days that remain on your trip.
Any credit resulting from cancellation under the Force Majeure clause does not have an expiry date and may be applied towards any other available tour offered by us. The credit is not redeemable for cash and excludes third party operators as they will have their own booking conditions.
In such circumstances, there will be no claim for damages by either party against the other, and we are not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
If you are unable to continue travelling with us due to a suspected or confirmed case of COVID-19, we can offer you a travel credit for the unused days of your trip.
If you cancel or reduce the total contract value, the following conditions apply:
Cancellations less than 61 days before commencement:
- Any cancellations, partial or otherwise, will attract a penalty equal to the value of the reduction in contract value
- In other words, no refunds due to contract reduction or cancellation will be payable to the client within 60 days of commencement.
We ask that you be waiting at the agreed pick-up location at least 15 minutes prior to the designated pick-up time. It is your responsibility to ensure that you are visible to the Kiff & Culture tour guide. If a guide is not easily able to locate you at the agreed pick-up location at the agreed pick-up time, we reserve the right to depart without you and you will be deemed to have cancelled your booking within 14 days of departure and no refund will be given.
On the Brisbane to Byron Food Trail, we will have a trailer available to carry luggage. Due to capacity constraints, we have a 15kg per person limit. We also have a size limit of 158cm based off the total dimensions of the luggage (e.g 70cm x 50cm x 38cm). We reserve the right to reject luggage in excess of this weight.
We do not accept bookings from passengers under 18 years of age, and by booking a trip with us you represent to us that you are at least 18 years of age. If you’re under 18 years old, you’ll need to be accompanied by a parent or guardian.
It is your responsibility to ensure that you are physically fit enough to participate in a trip with us. If you have any questions about fitness levels required, please ask us before you book a trip, because by booking a trip with us you represent to us that you are physically fit and capable of participating in the trip with us, and there are no health-related reasons or problems which preclude your participation in the trip. We highly recommend all passengers have travel insurance coverage.
You acknowledge and agree that participation in a trip with Kiff & Culture has inherent risks, dangers, and hazards, and may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that, could cause serious disability, and by booking a trip with us you assume all risks and dangers and all responsibility for any losses and/or damages that may arise during your participation in a trip with us.
At the time that you book a trip, on behalf of yourself, your personal representatives and your heirs, you voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify Kiff & Culture and all its officers, employees and contractors from any and all claims, actions or losses (including those that arise due to Kiff & Culture’s negligence or carelessness) for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of your participation in a trip with Kiff & Culture.
Please note that prior to participating in a trip (including boarding a Kiff & Culture vehicle), Kiff & Culture will require that you sign a written waiver and release of liability. Failure to do so will result in refusal to board and you will be deemed to have cancelled your trip within 7 days of departure (resulting in no refund of trip fees).
You agree to allow us to use photographs, quotes and video footage captured on your trip for promotional purposes, within our website and social media platforms. If you don’t wish to have your photograph featured, simply make this clear to us on the day of your tour verbally. Should there be any promotional material used without your consent that you would like removed please inform us so we can take action. All photography is taken in a tasteful, fun manner that we encourage our customers to share and embrace by crediting Kiff & Culture tours. Kiff & Culture retains personal information as permitted by law to resolve disputes and enforce our policies.
